Membership Program Terms & Conditions
These Membership Program Terms and Conditions (Terms) govern the Brisbane Motorcycles Membership Program (Program). By joining, renewing, accessing or using the Program, you agree to be bound by these Terms.
The Program is offered by Brisbane Motorcycles Pty Ltd (Brisbane Motorcycles, we, us or our). The person who joins or uses the Program is referred to as the Member, you or your.
These Terms are intended to be read together with any checkout terms, privacy policy, promotion terms, prize terms, service terms and any written offer that we publish for a specific benefit or promotion.
1. Definitions
Australian Consumer Law or ACL means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Business Day means a day other than a Saturday, Sunday or public holiday in Brisbane, Queensland.
Core Benefits means the membership benefits expressly stated in clause 5.1, as varied in accordance with these Terms.
Eligible Purchase means a purchase that qualifies for a discount or promotion under these Terms or the applicable Promotion Terms.
Member means an individual who has joined the Program and whose membership is current and not suspended or cancelled.
Promotion means a competition, trade promotion, giveaway, member draw, offer or promotional campaign conducted by Brisbane Motorcycles.
Promotion Terms means the specific rules published for a Promotion, including eligibility, entry method, prize details, dates and draw or judging criteria.
Service means a workshop service, repair, inspection, fitment, maintenance or related workshop activity performed by Brisbane Motorcycles.
2. Eligibility and membership account
The Program is available to individuals aged 18 years or over who are Australian residents, unless we approve otherwise in writing.
Membership is for personal use only. It is not transferable, assignable, shareable, redeemable for cash or available for resale.
You must provide accurate, complete and current information when joining and must promptly update any changed contact, billing or vehicle information.
We may refuse, suspend or cancel a membership where we reasonably believe the account is fraudulent, used commercially, used contrary to these Terms, or otherwise affects the integrity, safety or reputation of the Program.
Where possible and reasonable, we will give you notice and a fair opportunity to respond before suspending or cancelling a membership, except where urgent action is required to protect customers, staff, systems, property, legal compliance or the integrity of a Promotion.
3. Membership term, billing and renewal
Membership is billed monthly in advance unless a different billing period is displayed at checkout or agreed in writing.
The standard monthly fee is AUD $29.95 inclusive of GST. If a different fee is displayed at checkout, the displayed fee applies for that membership period.
By joining, you authorise us and our payment processor to charge the membership fee and any applicable charges to your nominated payment method on a recurring basis.
Your membership automatically renews at the end of each paid billing period unless you cancel before the next renewal date.
If a payment fails, we may reattempt payment, request updated payment details, suspend benefits, or cancel the membership if payment remains outstanding after reasonable notice.
You are responsible for ensuring your payment details remain valid and that you have authority to use the nominated payment method.
4. Cancellation, refunds and cooling off
You may cancel your membership at any time by using the cancellation method made available in your account, contacting Brisbane Motorcycles customer support, or emailing a cancellation request to the email address published by Brisbane Motorcycles for membership support.
Cancellation takes effect at the end of the then-current paid billing period unless we agree otherwise or applicable law requires otherwise. You may continue using the benefits until that period ends, provided the membership remains in good standing.
Membership fees are generally not refundable for change of mind, failure to use the Program, or cancellation part way through a billing period.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or entitlement that cannot lawfully be excluded, restricted or modified under the ACL or any other applicable law.
If we make a material change that substantially reduces the Core Benefits, you may cancel before the change takes effect and we will provide a pro-rata refund for any unused prepaid period if required by law or if we choose to do so as a customer service remedy.
5. Core Membership Benefits
Subject to these Terms, a current Member is entitled to the following Core Benefits:
- 5% off eligible parts and accessories purchased from Brisbane Motorcycles at standard retail price;
- 10% off eligible servicing supplied by Brisbane Motorcycles, subject to clause 7;
- VIP priority access to service booking opportunities, subject to workshop capacity and clause 8;
- access to member-only offers, communications, events, promotions and giveaways that we choose to make available from time to time.
Benefits are available only while your membership is current, fully paid and not suspended or cancelled.
Benefits are not cash, store credit, gift cards or property of the Member and are not redeemable for cash.
6. Parts and accessories discount conditions
The 5% parts and accessories discount applies to eligible parts, accessories and apparel sold by Brisbane Motorcycles at standard retail price.
Unless expressly stated otherwise, the discount does not apply to new motorcycles, used motorcycles, demonstrator vehicles, freight, shipping, insurance, registration, stamp duty, finance products, gift cards, deposits, sale or clearance items, workshop labour, external supplier charges, special-order items where the supplier margin is insufficient, or items already discounted below standard retail price.
Discounts cannot be combined with any other promotion, coupon, negotiated deal, staff discount, fleet discount, manufacturer campaign or price-match offer unless we expressly agree in writing.
If a discounted item is returned or refunded, the refund will be based on the amount actually paid after the membership discount and any applicable legal entitlement.
We may refuse or reverse a discount where we reasonably believe there has been error, misuse, fraud, resupply, commercial exploitation or a breach of these Terms.
7. Service discount conditions
The 10% service discount applies to eligible workshop servicing supplied directly by Brisbane Motorcycles and may apply to labour only unless we expressly state that it applies to the full service invoice.
The discount does not apply to third-party costs, towing, freight, outsourced work, insurance work, warranty work, manufacturer-paid work, internal jobs, registration inspections, government charges, tyres sold at promotional pricing, parts already discounted, or any item excluded at the time of quotation.
Where a written service quote is provided, the membership discount must be identified before the invoice is finalised. The discount may not be applied retrospectively after payment unless we agree otherwise.
All workshop work remains subject to our usual service terms, warranty terms, consumer guarantees, workshop availability, parts availability, technician availability and safety requirements.
8. VIP priority service booking access
VIP priority booking means we will make reasonable efforts to provide Members with preferential access to available service booking times compared with non-members.
VIP priority booking does not guarantee same-day service, immediate availability, a specific booking date, faster repair completion, priority parts supply, priority warranty approval, or any fixed turnaround time.
All service bookings remain subject to workshop capacity, staffing, diagnostic requirements, parts availability, safety requirements, manufacturer procedures, customer approval and operational constraints.
We may reschedule, delay or decline a service booking where reasonably necessary for operational, safety, staffing, supplier, legal or customer service reasons.
9. Member promotions and giveaway framework
Promotions are optional benefits that may be offered to Members from time to time. There is no guarantee that a Promotion will be available in every month or membership period.
Each Promotion will be governed by its own Promotion Terms. If there is any inconsistency between these Terms and the Promotion Terms, the Promotion Terms prevail to the extent of the inconsistency for that Promotion.
Unless expressly stated in the Promotion Terms, entries in a Promotion are provided as an incidental promotional benefit of membership or an Eligible Purchase and are not sold separately.
You must not pay a separate amount solely for an entry. If a Promotion requires purchase of goods or services, the goods or services must be available at their usual price and the entry must be incidental to that purchase.
Where required or considered appropriate by Brisbane Motorcycles, we may provide a free alternative entry method, skill-based element, permit/authority details, geographic restrictions, or other compliance controls.
Promotions may be restricted to Queensland residents or to specified states or territories. If a Promotion is open outside Queensland, we may need to obtain permits, authorities or approvals before launch depending on the promotion structure and prize pool.
10. Promotion entries
Entries are not legal tender, cash, credit, property or stored value. They cannot be sold, transferred, assigned, exchanged, gifted, refunded or redeemed for cash.
The entry allocation method, maximum entries, eligibility criteria, opening date, closing date, draw date, judging criteria and winner notification process must be stated in the Promotion Terms for the relevant Promotion.
We may audit, adjust, withhold, invalidate or cancel entries where we reasonably believe there has been error, duplicate entry, fraud, automated entry, manipulation, refund, chargeback, breach of these Terms, breach of the Promotion Terms, or conduct that affects the integrity of the Promotion.
If your Eligible Purchase is cancelled, refunded, reversed or charged back, any related entries may be cancelled.
A Member whose membership is suspended, cancelled, unpaid, fraudulent or not in good standing at the time of the draw or prize determination may be disqualified, unless the Promotion Terms or applicable law requires otherwise.
11. Prizes and winner obligations
Prize details, prize value, number of prizes, prize restrictions and prize delivery arrangements will be set out in the Promotion Terms.
Unless the Promotion Terms state otherwise, prizes are not transferable, exchangeable or redeemable for cash.
If a prize is unavailable for reasons beyond our reasonable control, we may substitute a prize of equal or greater value where permitted by law and, where required, with any necessary regulatory approval.
If a prize includes a motorcycle, vehicle, riding experience, service credit, parts, accessories or third-party product, the winner is responsible for any licence, safety gear, insurance, registration, transfer, stamp duty, running costs, travel costs, installation costs, ancillary costs and legal eligibility requirements unless the Promotion Terms state otherwise.
We may require a winner to provide proof of identity, age, residency, membership status, purchase eligibility and compliance with these Terms before awarding a prize.
If a winner does not claim a prize within the timeframe stated in the Promotion Terms, or is ineligible, unavailable or disqualified, we may conduct a redraw or award the prize to another eligible entrant in accordance with the Promotion Terms and applicable law.
12. Fair use and misuse
You must use the Program honestly, reasonably and for personal purposes only.
You must not manipulate purchases, refunds, entries, accounts, contact details, payment details, booking requests, discount claims or promotion processes to obtain an unfair advantage.
You must not use the Program for resale, commercial purchasing, bulk purchasing, unauthorised account sharing, fraudulent activity, harassment, abusive conduct, unlawful conduct or conduct that damages our staff, customers, systems, suppliers, brands or reputation.
We may impose reasonable limits, decline transactions, cancel benefits, suspend accounts or cancel memberships where necessary to prevent misuse or protect the integrity of the Program.
13. Changes to the Program or these Terms
We may make reasonable changes to the Program, benefits, fees, discounts, eligibility rules, operational processes, Promotion rules or these Terms where the change is required or reasonably necessary for legal, regulatory, operational, security, supplier, technology, commercial or customer service reasons.
If a change materially reduces the Core Benefits or increases the membership fee, we will provide reasonable prior notice where practicable and give affected Members a reasonable opportunity to cancel before the change takes effect.
Changes that are minor, beneficial, required by law, required for urgent security or safety reasons, or do not materially affect your rights may take effect immediately.
The current version of these Terms will be published on our website or otherwise made available to Members.
14. Communications and marketing
We may send you operational communications about your membership, billing, bookings, purchases, service work, account status, safety matters and Promotions.
We may send marketing communications where we have your consent or are otherwise permitted by law.
Marketing communications may include offers, events, promotions, products, services, surveys and membership updates.
You may unsubscribe from marketing communications at any time using the unsubscribe facility in the message or by contacting us. Unsubscribing from marketing communications does not stop operational messages that are reasonably necessary to administer your membership, transactions or legal obligations.
You must ensure your contact details are accurate. We are not responsible for missed notices, booking changes, renewal reminders, prize notifications or other communications caused by incorrect or outdated contact details.
15. Privacy
We collect, use, store and disclose personal information to operate the Program, process payments, provide benefits, administer bookings and purchases, conduct Promotions, verify eligibility, communicate with you, comply with law, prevent fraud and improve our products and services.
We may disclose personal information to service providers including payment processors, marketing platforms, IT providers, professional advisers, promotion administrators, regulators, suppliers and delivery providers where reasonably necessary for those purposes.
If you enter a Promotion, you consent to us using and publishing your name, suburb, state, image, voice, social media handle or submitted content for winner announcement, promotional and publicity purposes where stated in the Promotion Terms and permitted by law.
Our handling of personal information is subject to our Privacy Policy. You may contact us to request access to or correction of your personal information.
16. Intellectual property and member content
All Program names, branding, materials, website content, promotional content, designs, software, systems and other intellectual property remain owned by or licensed to Brisbane Motorcycles.
You must not copy, reproduce, modify, scrape, misuse or exploit any Program content except for personal use in connection with your membership.
If you submit reviews, photos, videos, comments, testimonials or other content to us or in connection with a Promotion, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, publish and communicate that content for Program, marketing and promotional purposes, subject to applicable law and any express restrictions stated in the Promotion Terms.
17. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy, condition, warranty or liability that cannot lawfully be excluded, restricted or modified under the ACL or any other applicable law.
To the maximum extent permitted by law, any warranties, representations or guarantees not expressly stated in these Terms are excluded.
Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to resupplying the relevant goods or services, repairing the goods, replacing the goods, paying the cost of repair or replacement, or paying the cost of having the services supplied again.
18. Liability
To the maximum extent permitted by law, we are not liable for indirect, consequential, special, exemplary or punitive loss, loss of profit, loss of opportunity, loss of goodwill, loss of data, or loss arising from events outside our reasonable control.
We are not liable for failure or delay caused by supplier issues, manufacturer delays, parts unavailability, payment processor outages, telecommunications failures, website outages, cyber incidents, regulatory changes, natural disasters, industrial action, staffing shortages or other circumstances beyond our reasonable control.
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.
19. Indemnity
You indemnify Brisbane Motorcycles and its officers, employees and agents against reasonable losses, liabilities, damages, costs and expenses arising from your breach of these Terms, fraud, unlawful conduct, misuse of the Program, unauthorised account use caused by your failure to keep account details secure, or breach of Promotion Terms.
This indemnity does not apply to the extent the loss is caused by our negligence, breach of these Terms, breach of law or wilful misconduct.
20. Suspension and termination by Brisbane Motorcycles
We may suspend or terminate your membership if you materially breach these Terms, fail to pay fees, misuse benefits, engage in fraud, threaten or abuse staff, breach Promotion Terms, provide false information, or engage in conduct that reasonably requires suspension or termination to protect the Program, our business, staff, customers or legal compliance.
Where reasonable, we will notify you of the reason and provide an opportunity to remedy the issue before termination. Immediate suspension or termination may occur where urgent action is reasonably necessary.
If we terminate for your material breach, you may lose access to benefits and entries from the termination date, subject to applicable law.
If we terminate without cause, we will provide a pro-rata refund for any unused prepaid membership period.
21. Complaints and disputes
If you have a complaint or dispute about the Program, you should first contact Brisbane Motorcycles with details of the issue and the outcome you are seeking.
Both parties agree to use reasonable endeavours to resolve disputes in good faith before commencing legal proceedings, except where urgent interlocutory relief is required or where a claim is brought in a tribunal or small claims process that does not require pre-action negotiation.
This clause does not prevent either party from exercising rights under the ACL or any other applicable law.
22. General
If part of these Terms is invalid, illegal or unenforceable, that part is severed to the extent necessary and the remainder continues in force.
A failure or delay in exercising a right is not a waiver of that right.
You must not assign or transfer your membership without our prior written consent. We may assign or transfer our rights or obligations in connection with a business sale, restructure or transfer of the Program, provided this does not materially reduce your rights under these Terms.
These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.
